ORDINANCE NO. BL2013-379

An ordinance to amend Section 8.12.020 of the Metropolitan Code pertaining to the keeping of chickens on community garden property within the Gallatin Pike Specific Plan zoning district.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 8.12.020 of the Metropolitan Code is hereby amended by deleting the phrase “on residential and public school property” wherein it appears in the first sentence of subsection C.

Section 2. Section 8.12.020 of the Metropolitan Code is hereby amended by amending subsection C.1. by adding after the phrase “Except for hens kept on school properties for educational purposes pursuant to subsection N. of this section”, the phrase “or kept on non-commercial community garden property located both within the Gallatin Pike improvement specific plan (SP) zoning district and the East Bank redevelopment district”.

Section 3. Section 8.12.020 of the Metropolitan Code is hereby amended by adding the following new subsection O.:

“O. Specific provisions for permits for non-commercial community garden property located both within the Gallatin Pike improvement specific plan (SP) zoning district and the East Bank redevelopment district.
1. Adequate nearby access to hand washing facilities, which include hot and cold water, single service paper towels, and hand soap, shall be provided.
2. Adequate access to electricity for the enclosure shall be provided in order to provide adequate temperature control.
3. The applicant must provide the department with the residential address and phone number of three (3) individuals willing to be on call to address any issues regarding this section.
4. The maximum number of domesticated hens allowed under this subsection is six (6).”

Section 4. That this Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2013-379 by amending Section 3 by adding the following provision at the end thereof:

“5. The applicant must submit a written plan that adequately addresses the handling, dispersal, and/or disposal of eggs produced by their domesticated hens. Such plan shall, at a minimum, address hand washing, the cleansing of eggs, and arrangements for the refrigeration of eggs.”
