ORDINANCE NO. BL2013-368

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by closing and abandoning a portion of the Division Street right-of-way and easements, and to authorize the execution of a quitclaim deed to convey any interest the Metropolitan Government possesses in right-of-way at the intersection of Division and Broadway that would not already be extinguished by the aforementioned abandonment (Proposal No. 2013M-002AB-002).

Whereas, the owners of the abutting properties have requested that the Metropolitan Government close and abandon the portion of the public right-of-way (the “ROW”) at the intersection of Division and Broadway, as shown on the sketch attached as Exhibit A; and,

Whereas, the closure and abandonment of the ROW has been requested by the Littlejohn Engineering Associates on behalf of Lagasse Family Partners, LLC (Grantee); and,

Whereas, the Metropolitan Government of Nashville and Davidson County has no further need for the ROW; and,
Whereas, in order to clarify the fee ownership of the property currently burdened by the ROW, Grantee has further requested that the Metropolitan Government quitclaim such interest as it may possess in such property to Grantee pursuant to the deed attached as Exhibit B.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. 2012-323 be and hereby is amended, as follows:

The Division Street right-of-way at Broadway, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, is hereby abandoned.

Section 2. That said right-of-way, including all utility easements within it, are herein closed and abandoned.

Section 3. That the Director of the Department of Public Works be and hereby is authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 4. That the Director of Public Property Administration or his designee is authorized to execute the quitclaim deed attached hereto as Exhibit B conveying such interest as the Metropolitan Government may have in the Property to Lagasse Family Partners, LLC.

Section 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
