ORDINANCE NO. BL2013-367

An ordinance to negotiate and accept permanent and temporary easements for the Ezell Road Stormwater Improvement Project on nineteen (19) properties located along Bakertown Road, Ezell Road, Lallemond Drive, and Wharton Drive (Proposal No. 2012M-035ES-001).

WHEREAS, an ordinance to accept permanent and temporary easements for the Ezell Road Stormwater Improvement Project on nineteen (19) properties located along Bakertown Road, Ezell Road, Lallemond Drive, and Wharton Drive; and,

WHEREAS, the Metropolitan Planning Commission approved this mandatory referral No. 2012M-035ES-001 on December 26, 2012, for acceptance of said easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government is authorized to negotiate and accept permanent and temporary easements located along Bakertown Road, Ezell Road, Lallemond Drive and Wharton Drive indicated on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
