ORDINANCE NO. BL2013-363

An ordinance approving the Metropolitan Government to abandon easement rights that were retained by Council Ordinance BL94-1115, within the former rights-of-way of Alley #583 and Alley #585, on properties located at the northwest corner of Albion Street and 21st Avenue North (Proposal No. 2012M-039ES-001).

WHEREAS, The abandonment of the easement rights are required to construct the Meharry Medical College Turner Family Center on properties located at the northwest corner of Albion Street and 21st Avenue North; and,

WHEREAS, The Department of Water and Sewerage Services does not have utility lines in the easements; and,

WHEREAS, The Metropolitan Planning Commission approved mandatory referral No. 2012M-039ES-001 on December 5, 2012, for abandonment of said easements rights.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon easement rights on the properties located at the northwest corner of Albion Street and 21st Avenue North and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
