ORDINANCE NO. BL2013-357

An ordinance approving the Metropolitan Government to abandon water, sewer, and stormwater mains and easement rights for the Music City Center Project (09-SL-0020 & 09-WL-0022) on properties located between 5th Avenue South and Korean Veterans Boulevard and 8th Avenue South and Demonbreun Street. (Proposal No. 2012M-036ES-001).

WHEREAS, The abandonment of the water, sewer, and stormwater mains and easement rights is needed to construct the Music City Center Project on properties between 5th Avenue South and Korean Veterans Boulevard and 8th Avenue South and Demonbreun Street; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2012M-036ES-001 on November 20, 2012, for abandonment of said infrastructure, easements, and right-of-way.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon all or a portion of easements existing in properties located between 5th Avenue South and Korean Veterans Boulevard and 8th Avenue South and Demonbreun Street, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
