ORDINANCE NO. BL2013-347

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by abandoning a portion of Clark Street, 7th Avenue South 6th Avenue South, Shirley Street, Alley No. 114, Alley No. 137, and Alley No. 145 right-of-way and easements (Proposal Number 2012M-018AB-001).

WHEREAS, it is the desire of all the abutting property owners that said abandonment be accomplished; and,

WHEREAS, the closure has been requested by Barge, Waggoner, Sumner & Cannon, Inc.; and,

WHEREAS, there is no future need for said portions of right-of-way for Metropolitan Government of Nashville and Davidson County purposes due to the development of the Music City Center.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. 2011-55, be and hereby is amended, as follows:

Clark St: from 6th Ave S to 8th Ave S
7th Ave S: from Demonbreun St to Shirley St
Shirley St: from 6th Ave S to 8th Ave S along the northern side of Korean Veterans Blvd
6th Ave S: a strip along it’s westerly side from Demonbreun St to Korean Veterans Blvd
6th Ave S: a strip along its easterly side from Korean Veterans Blvd to the south property line of parcel 475 on Map 93-10
Alley #114: from Shirley St northwestward to the terminus at the south property line of parcel 104 on Map 93-10
Alley #137: from 7th Ave s to Alley #145
Alley #145: from Shirley St to alley #137
All of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, is hereby abandoned.

Section 2. That said right-of-ways, including all utility easements within them, are herein abandoned.

Section 3. That the Director of the Department of Public Works be and hereby is authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
