SUBSTITUTE ORDINANCE NO. BL2013-346
An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by abandoning a portion of Alley No. 207 and Alley No. 209 right-of-way, along with certain utility and drainage easements (Proposal Nos. 2012M-017AB-001 and 2012M-040ES-001).
WHEREAS, it is the desire of all the abutting property owners that said abandonment be accomplished; and
WHEREAS, the closure has been requested by Littlejohn Engineering Associates; and
WHEREAS, there is no future need for said portion of right-of-way for Metropolitan Government of Nashville and Davidson County for roadway purposes; and,
WHEREAS, the abandonment of the alleys and easements in the alleys have been recommended by the Metropolitan Planning Commission in Mandatory Referrals No. 2012M-017AB-001 and No. 2012M-040ES-001.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. 2011-55, be and is hereby amended, as follows:
Alley No. 207 and Alley No. 209 to be abandoned from Hume Street to Taylor Street between 5th Avenue North and Rosa L. Parks Boulevard, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this Ordinance as though copied herein, is hereby abandoned except for certain easements herein described, which shall be retained.
Section 2. That the existing public utility and drainage easements in existing Alley No. 209 and part of Alley No. 207 are abandoned by the Metropolitan Government. The existing public utility and drainage easements in a portion of Alley No. 207 shown on attached Exhibit 1 are to be retained.
Section 3. In the event there is proposed any construction over, above, or under said existing utilities, that said construction shall have the approval of the Director of Public Works and/or the Director of Water and Sewerage Services, together with the approval of any other pertinent departments of the Metropolitan Government or other governmental agency, including the Nashville Electric Service.
Section 4. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 5. Amendments to this legislation shall be approved by resolution.
Section 6. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
