ORDINANCE NO. BL2013-342
An ordinance approving a license agreement with the State of Tennessee, Department of Transportation for the use and benefit of the Board of Parks and Recreation in the construction and maintenance of the Richland Creek Greenway (Proposal No. 2012M-002OT-001).
WHEREAS, the State of Tennessee has offered to license, pursuant to the terms of the agreement attached hereto as Exhibit A, to The Metropolitan Government of Nashville and Davidson County, by and through the Board of Parks and Recreation, a portion of State right-of-way to construct a greenway trail; and,
WHEREAS, The Metropolitan Government of Nashville and Davidson County plans to construct greenway improvements that intersect Tennessee Department of Transportation’s project as approximately shown and described in the attached license agreement; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this license agreement be approved.
NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The license agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.
Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.
Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
