ORDINANCE NO. BL2012-337

An ordinance amending Section 17.16.210 of the Metropolitan Code, Zoning Regulations, to modify the distance requirements for construction/demolition landfills (Proposal No. 2013Z-002TX-001).

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 17.16.210 of the Metropolitan Code, Zoning Regulations, is hereby amended by amending subsection A. by adding the following provision at the end of subsection A.1.:

“In addition to the foregoing, if the property is located within the AG or AR2a zoning district, such facility shall not be located within two thousand feet of the property line of any platted subdivision containing at least twenty-five single or two family dwellings for which occupancy permits have been issued by the department of codes administration.“

Section 2. That this Ordinance shall take from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
