ORDINANCE NO. BL2012-335

An ordinance approving an agreement granting Vanderbilt University’s LifeFlight and Police Department access to the 800-MHZ system for public safety and emergency services purposes.

WHEREAS, The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the Electric Power Board of The Metropolitan Government of Nashville and Davidson County ("NES") jointly own and operate an emergency radio dispatch and response system utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission ("FCC"); and,

WHEREAS, Vanderbilt University LifeFlight and Vanderbilt University Police Department perform certain public safety and emergency services functions; and,

WHEREAS, Vanderbilt University (“Vanderbilt”) desires to interface directly with the Metropolitan Government/NES system infrastructure for dispatch console connectivity; and,

WHEREAS, Vanderbilt has requested for its Police Department and LifeFlight to be granted dedicated talkgroup access to the System; and,

WHEREAS, access to the System would enhance Vanderbilt’s ability to discharge its public safety and emergency services duties and would also benefit the Metropolitan Government's efforts to provide public safety; and,

WHEREAS, the Metropolitan Government, NES and Vanderbilt have agreed upon the terms of an agreement to allow Vanderbilt LifeFlight and Vanderbilt Police Department access to the Metropolitan Government/NES system.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement by and between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and Vanderbilt University for access to the Metropolitan Government/NES 800-MHZ System for public safety and emergency services purposes, attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute said Agreement.

Section 2. That any new amendments to the Agreement between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and Vanderbilt University may be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
