ORDINANCE NO. BL2012-334

An ordinance amending Metropolitan Code Section 13.08.040 to restrict vendors permitted under that section from vending on public rights of way closed for the purpose of any special event for which the metropolitan government has given its official written permission during the limited period of time specified for the special event and within the area covered by the special event permit, unless they have the permission of the special event permit holder.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Metropolitan Code of Laws Section 13.08.040.B.6.g. is hereby deleted in its entirety and replaced with the following:

g. The owner of any wheeled and mobile vehicles, temporary stands, signs or displays or racks shall gain no right to compensation by virtue of being forced to move to allow access to utilities, regardless of the length of time incurred thereby. The practice of vending on any public roadway, street or sidewalks during the course of any special event as defined in subsection (B)(2)(h) of this section for which the metropolitan government has given its official written permission to close or otherwise alter the normal, everyday use of any public roadway, street or sidewalk, shall be prohibited during the limited period of time specified for the special event and within the area covered by the special event permit by any vendor licensed or permitted pursuant to this section unless they have the permission of the special event permit holder.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government requiring it.

Madam President:

I move to amend Ordinance No. BL2012-334 by:

1. Deleting Section 1 thereof in its entirety and replacing it with the following:

Section 1. Metropolitan Code of Laws Section 13.08.040.B.6.g. is hereby deleted in its entirety and replaced with the following:

g. The owner of any wheeled and mobile vehicles, temporary stands, signs or displays or racks shall gain no right to compensation by virtue of being forced to move to allow access to utilities, regardless of the length of time incurred thereby.

2. Adding a new Section 2, to read as follows:

Section 2. A new subsection “l.” is hereby added, following subsection k., at the end of Metro Code of Laws Section 13.08.040.B.6., to read as follows:

l. The practice of vending on any public roadway, street or sidewalks during the course of any special event as defined in subsection (B)(2)(h) of this section for which the metropolitan government has given its official written permission to close or otherwise alter the normal, everyday use of any public roadway, street or sidewalk, shall be prohibited during the limited period of time specified for the special event and within the area covered by the special event permit by any vendor licensed or permitted pursuant to this section unless they have the permission of the special event permit holder.

3. Renumbering the existing “Section 2” as “Section 3.”
