ORDINANCE NO. BL2012-319

An ordinance approving a lease agreement between the Metropolitan Development and Housing Agency and the Metropolitan Government for use of portions of the facilities located at J. Henry Hale Housing Development (Proposal No. 2012M-034PR-001).

WHEREAS, The Metropolitan Nashville Public Schools, through a lease agreement with the Metropolitan Development and Housing Agency (MDHA), operates programs for adults and students using a portion of the MDHA-owned facilities on the property known as J. Henry Hale Housing Development, and

WHEREAS, the programs are proposed to operate at this location for the benefit of MNPS students and adults, and

WHEREAS, the MDHA has proposed a lease with the Metropolitan Nashville Public Schools for the use of a portion of its facilities on the property of the J. Henry Hale Housing Development; and

WHEREAS, this lease has been approved by the Metropolitan Planning Commission, and

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this lease agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the lease agreement entered into between The Metropolitan Government of Nashville and Davidson County and the Metropolitan Development and Housing Agency and approved by the Metropolitan Board of Public Education, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2: That any new amendments to this lease agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
