ORDINANCE NO. BL2012-317

An ordinance approving the Metropolitan Government to abandon approximately 135 feet of an 8 inch public sewer main with one manhole and to accept approximately 150 feet of an 8 inch public sewer main with three manholes for Project No. 10-SL-0167 on property located at 113 Page Road (Proposal No. 2012M-027ES-001).

WHEREAS, The abandonment of approximately 135 feet of an 8 inch public sewer main with one manhole and to accept approximately 150 feet of an 8 inch public sewer main with three manholes for Project No. 10-SL-0167 on property located at 113 Page Road is needed to construct the Phyllis Vaughn Property Project; and,

WHEREAS, The Metropolitan Planning Commission approved mandatory referral No. 2012M-027ES-001 on August 27, 2012, for the abandonment and acceptance of said sewer mains.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon and accept sewer mains on the property located below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
