ORDINANCE NO. BL2012-315

An ordinance amending section 4.46.060 of the Metropolitan Code pertaining to the Procurement Nondiscrimination Program to change the frequency of benchmarking.

WHEREAS, Ordinance No. BL2008-161 amended Title 4 of the Metropolitan Code to establish the Procurement Nondiscrimination Program; and,

WHEREAS, Metropolitan Code § 4.46.060(B) provides that the Office of Minority and Women Business Assistance shall establish and recommend proposed benchmarks to the Purchasing Agent and Finance Director annually; and,

WHEREAS, Metropolitan Code § 4.46.060(D) provides that benchmarks shall be in effect for a period of one year and shall be reviewed semiannually; and,

WHEREAS, the Metropolitan Government of Nashville and Davidson County engaged Griffin & Strong, P.C., to provide a comprehensive review of established statistical Minority or Women Owned Business Enterprise (“MWBE”) availability benchmarks and an analysis of benchmarks as compared to actual MWBE vendor utilization in Metropolitan Nashville procurements; and,

WHEREAS, Griffin & Strong has recommended that benchmarking be done every two years instead of every year; and,

WHEREAS, it would be in the best interest of the Metropolitan Government to change the frequency of benchmarking to allow for any necessary improvements which may be revealed by the previous benchmarking to be made.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Metropolitan Code § 4.46.060 is hereby amended by deleting the word “annually” in the second sentence of Subsection (B) and substituting in lieu thereof the word “biennially.”

Section 2. That Metropolitan Code § 4.46.060 is hereby amended by deleting the term “one year” in the second sentence of Subsection (D) and substituting in lieu thereof the term “two years.”

Section 3. That Metropolitan Code § 4.46.060 is hereby amended by deleting the word “semiannually” in the third sentence of Subsection (D) and substituting in lieu thereof the word “annually.”

Section 4. That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
