ORDINANCE NO. BL2012-300

An ordinance approving the Metropolitan Government to abandon a portion of easement rights that were previously retained by Council Ordinance BL73-611 within a portion of the former right-of-way of 9th Avenue South on the property located at 921 S. Douglas Avenue (Proposal No. 2012M-031ES-001).

WHEREAS, The abandonment of a portion of the easement rights that were previously retained by Council Ordinance BL73-611 within a portion of the former right-of-way of 9th Avenue South on a portion of property located at 921 S. Douglas Avenue was requested by J. Miller Enterprises, LLC, the property owner ; and,

WHEREAS, The Metropolitan Planning Commission approved mandatory referral No. 2012M-031ES-001 on September 28, 2012, for the abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon a portion of the easement on the property located below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
