ORDINANCE NO. BL2012-287

An ordinance approving a lease agreement between the State of Tennessee and the Metropolitan Government of Nashville and Davidson County for the use and benefit of the Board of Parks and Recreation; and approving a sublease agreement between the Metropolitan Government of Nashville and Davidson county, by and through the Board of Parks and Recreation, and the Harpeth Youth Soccer Association (Proposal No. 2012M-018PR-001).

WHEREAS, pursuant to Ordinance No. 088-150, the State of Tennessee has leased a certain piece of property in Davidson County that is suitable for recreational purpose to the Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Board of Parks and Recreation; and,

WHEREAS, the Metropolitan Government has subleased that same property to the Harpeth Youth Soccer Association for use as a public recreational soccer park; and,

WHEREAS, the term of the current lease agreement between the State of Tennessee and the Metropolitan Government for the subject property ends on December 31, 2012; and,

WHEREAS, the State of Tennessee has proposed a new lease with the Metropolitan Government for continued use of the property for public recreational purposes; and,

WHEREAS, the Board of Parks and Recreation deems it desirable to continue to lease the subject property from the State of Tennessee; and,

WHEREAS, the Board of Parks and Recreation also deems it desirable to continue to sublease the subject property to the Harpeth Youth Soccer Association for use as a public recreational soccer park; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that the lease and sublease agreements be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the lease agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, attached hereto and incorporated herein as Exhibit A, is hereby approved and the Metropolitan County Mayor is authorized to execute the same.

Section 2. That the sublease agreement between the Metropolitan Government of Nashville and Davidson County and the Harpeth Youth Soccer Association, attached hereto and incorporated herein as Exhibit B, is hereby approved, and the Metropolitan County Mayor is authorized to execute the same.

Section 3. That any new amendments to the lease agreement between the State and the Metropolitan Government of Nashville and Davidson County shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 4. That any new amendments to the sublease agreement between the Harpeth Youth Soccer Association and the Metropolitan Government of Nashville and Davidson County shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 5. That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
