ORDINANCE NO. BL2012-285

An ordinance approving a lease agreement with the State of Tennessee, Department of Transportation, in relation to construction and maintenance of a greenway trail (Proposal No. 2012M-024PR-001).

WHEREAS, the State has offered to lease, pursuant to the terms of the lease agreement attached hereto as Exhibit A, to The Metropolitan Government of Nashville and Davidson County, by and through the Board of Parks and Recreation, the State right-of-way to construct a greenway trail; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this lease agreement be approved.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The lease agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
