ORDINANCE NO. BL2012-269

An ordinance authorizing the fee simple acquisition of a portion of property located at 826 Cammack Court for the Reservoir and Detention Basin Project No. 10-WG-069, approximately 875 feet east of Rodney Drive (Proposal No. 2012M-022PR-001).

WHEREAS, it is in the public interest that property be acquired to permit the construction or other use of water mains, sanitary sewers, reservoirs, stormwater, and/or appurtenances within the area designated for the construction of Project No. 10-WG-0069, West Meade Reservoir Acquisition; and,

WHEREAS, BL2011-43 authorized acquisitions of an easement for the project, but it was decided that Metro Water Services needs to acquire fee simple ownership rights for this property, due to the restricted use of the land; and,

WHEREAS, Project No. 10-WG-0069, West Meade Reservoir Acquisition, has been funded under Capital Improvements Budget No. 09WS0017; and,

WHEREAS, The Metropolitan Planning Commission approved this acquisition on June 26, 2012, Proposal No. 2012M-022PR-001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Director of Public Property Administration is hereby authorized to acquire by negotiation or condemnation fee simple title in the following described property on the attached map, for the purpose of construction or other use of water mains, sanitary sewers, reservoirs, stormwater and/or appurtenances, the initial such project being Project No. 10-WG-0069, the same being for a public purpose and the public convenience requiring it.

Section 2. The property to be acquired is shown on the plans for Project No. 10-WG-0069, West Meade Reservoir Acquisition, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, and a list of the property address, map and parcel number is as follows:

Section 3: The Director of Public Property Administration is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for the construction or other use of water mains, sanitary sewers, reservoirs, stormwater and/or appurtenances.

Section 4: All necessary and incidental costs of the property acquisition herein authorized to be acquired shall be paid from funds authorized from the Extension and Replacement Fund.

Section 5: Acquisition of additional property interests for the project shall be approved by resolution.

Section 6: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
