ORDINANCE NO. BL2012-259

An ordinance approving the Metropolitan Government of Nashville and Davidson County to abandon a Metropolitan Government Water Pumping Station located at 801 Stoner Mill Lane and the associated easement (Proposal No. 2012M-024ES-001).

WHEREAS, Abandonment of the Metropolitan Government Water Pumping Station and the associated easement has been requested by the 801 Stoner Mill Lane property owner; and,

WHEREAS, the Metropolitan Water Pumping Station and associated easements are no longer being used by the Department of Water and Sewerage Services, nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2012M-024ES-001 on August 1, 2012, for abandonment of said pumping station and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon the pump station and easement on the property located below and shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
