ORDINANCE NO. BL2012-258

An ordinance approving the abandonment of approximately two hundred sixty-five feet (265’) of existing ten inch (10”) sewer and one hundred thirty-five feet (135’) of existing twelve inch (12”) sewer, and the acquisition of easement for approximately three hundred seven feet (307’) of a new twelve (12”) sewer on property located at 615 Nestor Street (Project No. 10-SG-0088) (Proposal No. 2012M-018ES-001).

WHEREAS, The abandonment and acquisition of sewer mains are needed to construct Metro Water Services Project No. 10-SG-0088 on property located at 615 Nestor Street; and,

WHEREAS, The Metropolitan Planning Commission approved the abandonment and acceptance of the sewer lines in mandatory referral No. 2012M-018ES-001, dated June 12, 2012.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to abandon and acquire easements on a portion of the properties located below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acquisition authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
