ORDINANCE NO. BL2012-252

An ordinance approving the Metropolitan Government to abandon two hundred fifteen feet (215’) of a sanitary sewer main and easements and to accept five hundred ninety feet (590’) of relocated eight inch (8”) PVC sanitary sewer on properties located at 1600 Rosa L. Parks Boulevard and Rosa L. Parks Boulevard (unnumbered) (Project No. 12-SL-0043) (Proposal No. 2012M-023ES-001).

WHEREAS, The abandonment and acceptance of the sewer main and easements are needed to construct the Evergreen @ Werthan project on the property located at 1600 Rosa L. Parks Boulevard and Rosa L. Parks Boulevard (unnumbered); and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2012M-023ES-001 on July 17, 2012, for abandonment and acceptance of said sewer main and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Government is authorized to abandon and accept all or a portion of the properties located below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2: The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3: Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
