ORDINANCE NO. BL2012-251

An ordinance approving a facilities use agreement between the Metropolitan Nashville Public Schools and Nashville State Community College (Proposal No. 2012M-029PR-001).

WHEREAS, Nashville State Community College owns certain real property located at 5248 Hickory Hollow Parkway, Nashville, Tennessee, 37013, commonly known as the Hickory Hollow Mall, and the Metropolitan Government, by and through the Metropolitan Nashville Public Schools has negotiated the attached facilities use agreement; and,

WHEREAS, the Metropolitan Nashville Public Schools have determined that the aforesaid property is acceptable and sufficient to its need for a temporary location until a longer term contract is agreed upon for the Academy at Hickory Hollow for the upcoming 2012-2013 school year, and the facility is being provided at no charge to the Metropolitan Nashville Public Schools; and,

WHEREAS, the Director of Public Property Administration is authorized to lease real property, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Facilities Use Agreement by and between Nashville State Community College and the Metropolitan Nashville Public Schools for the use of approximately 4,000 sq. ft. of space with MNPS paying no rental fee, and for a term beginning on or about September 4, 2012 and ending on or about December 31, 2012, a copy of which is attached hereto and incorporated herein, and the same is hereby approved.

Section 2. That any amendments to this License Agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
