ORDINANCE NO. BL2012-238

An ordinance authorizing the Director of Public Property to accept and record easements in favor of the Metropolitan Government of Nashville and Davidson County on certain parcels of property for use in the Harpeth River and Mill Creek Greenway systems (Proposal No. 2012M-026ES-001).

WHEREAS, pursuant to the terms of the agreement attached hereto as Exhibit A to this ordinance, the owners of that property known as Davidson County Tax Map 156-02-0 Parcel 183.00 have agreed to donate an easement to the Metropolitan Government of Nashville and Davidson County for use in connection with the Harpeth River Greenway; and,

WHEREAS, pursuant to the terms of the agreement attached hereto as Exhibit B to this ordinance, the owners of that property known as Davidson County Tax Map 181-02-A Parcel 145.00 have agreed to donate an easement to the Metropolitan Government of Nashville and Davidson County for use in connection with the Mill Creek Greenway; and,

WHEREAS, the Metropolitan Board of Parks and Recreation has approved the acceptance of these easements; and,

WHEREAS, the easements will be used to construct, operate, and maintain portions of the greenway systems; and,

WHEREAS, the citizens of Nashville and Davidson County will benefit by accepting the donated easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Director of the Division of Public Property Administration and the Director of Parks and Recreation are authorized to accept and record the easements from the owners of the parcel of property pursuant to the terms of the agreement attached hereto as Exhibits A and B and incorporated herein.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
