ORDINANCE NO. BL2012-227
An ordinance approving the Metropolitan Government to acquire permanent and temporary easements for the Jackson’s View Stormwater Improvement Project (11-SWC-0313) on fifteen properties located along Andrew Jackson Way, Bret Ridge Drive, Carriage Way Court, Jacksons Hill Road, Jacksons Valley Road and Jacksons View Road (Proposal No. 2012M-015ES-001).
WHEREAS, The acquisition of permanent and temporary easements are needed to construct the Jackson’s View Stormwater Improvement Project on fifteen properties located along Andrew Jackson Way, Bret Ridge Drive, Carriage Way Court, Jacksons Hill Road, Jacksons Valley Road and Jacksons View Road; and,
WHEREAS, The Metropolitan Planning Commission approved mandatory referral No. 2012M-015ES-001, on May 17, 2012, recommending acquisition of easements required for Project 11-SWC-0313.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government is authorized to acquire permanent and temporary easements along Andrew Jackson Way, Bret Ridge Drive, Carriage Way Court, Jacksons Hill Road, Jacksons Valley Road and Jacksons View Road, shown on Exhibit 1 and 2 which are attached hereto and incorporated by reference.
Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acquisition authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
