ORDINANCE NO. BL2012-221

An ordinance authorizing the acquisition of property rights for the Vandiver Pump Station Upgrade Project (No.11-SC-109) (Proposal No. 2012M-014PR-001).

WHEREAS, The Department of Water and Sewerage Services must acquire property rights to construct the Vandiver Pump Station Upgrade Project, MWS Project No. 11-SC-109; and,

WHEREAS, In mandatory referral No. 2012M-014PR-001, dated June 12, 2012, the Metropolitan Planning Commission approved the acquisition of property rights on properties located at 1057 and 1059 N. Dupont Avenue, and 211 Rio Vista Drive, through easements or a fee simple take.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to acquire property rights on the properties located at 1057 and 1059 N. Dupont Avenue, and 211 Rio Vista Drive, as shown on Exhibit 1, attached hereto and incorporated herein by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acquisition authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
