ORDINANCE NO. BL2012-215

An Ordinance amending Chapter 5.04 of the Metropolitan Code to prohibit the use of Metropolitan Government funds to purchase, construct, or erect building or ground signs that identify the name of an elected or appointed official.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 5.04 of the Code of The Metropolitan Government of Nashville and Davidson County is hereby amended by adding the following new Section 5.04.100:

5.04.100 Limitation on use of metropolitan government funds for signage.
No funds of the metropolitan government shall be used to purchase, acquire, construct, or erect any ground or building sign measuring greater than one square foot in size that identifies the name of an elected or appointed official. Rather, all such signs shall only identify or advertise the name of the office or facility.

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2012-215 by amending Section 1 by adding the following provision at the end of the new Code Section 5.04.100:
“Notwithstanding the foregoing, this section shall not prohibit the placement of temporary signs identifying the mayor and member(s) of council associated with public infrastructure projects, or the placement of commemorative permanent signs or markers identifying elected officials in office at the time a public facility was funded and/or constructed.”
