ORDINANCE NO. BL2012-210

An ordinance approving a ground lease between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee for construction of a Tennessee Highway Patrol Communications Tower in Cane Ridge (Proposal No. 2012M-019PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County, through its Water Services Department, owns property in the Cane Ridge Community of Davidson County which is currently the site of a water tower and a communications tower belonging to the Metropolitan Government, and

WHEREAS, The Metropolitan Government of Nashville and Davidson County at the request of the State has negotiated a ground lease with the Tennessee Highway Patrol to permit the THP to install and maintain a communications tower and related equipment on this same property in Cane Ridge for a term of twenty-five (25) years, a copy of which is attached hereto; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2012M-019PR-001 on June 12, 2012 for approval of said lease, and

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this ground lease be approved.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the ground lease entered into between The Metropolitan Government of Nashville and Davidson County and the Tennessee Highway Patrol, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan County Mayor, or his designee, is authorized to execute the same.

Section 2: That any new amendments to this ground lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
