ORDINANCE NO. BL2012-207

An ordinance abandoning easements previously retained within the former rights-of-way of Alley numbers 104, 106 and 113 on property located at 719 Church Street (Proposal No. 2011M-005ES-002).

WHEREAS, Metropolitan Council Ordinance 97-693 retained easement rights within the former right-of-way of Alley number 104, and Metropolitan Council Ordinance BL2007-1553 retained easement rights within the former right-of-way of Alley numbers 106 and 113, on the property located at 719 Church Street; and,

WHEREAS, These easements are no longer being used by the Metropolitan Department of Water and Sewerage Services, nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved the abandonment of these easements in mandatory referral No. 2011M-005ES-002 on May 17, 2012.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government abandons any retained easements in Alley numbers 104, 106, and 113, as indicated on Exhibit 1 which is attached hereto and incorporated by reference.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to abandon the easements.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
