ORDINANCE NO. BL2012-186

An ordinance authorizing the donation to the Middle Tennessee Council of the Boy Scouts of America of a floating dock acquired in connection with the Metropolitan Government’s purchase of a home damaged in the May, 2010 flood.

WHEREAS, following the May, 2010 flood, the Metropolitan Government has acquired a number of flood-prone residential properties in an effort to minimize the effects of future floods; and,

WHEREAS, one of the properties purchased by the Metropolitan Government included a floating boat dock for which no department or agency of the Metropolitan Government has a current or foreseeable use; and,

WHEREAS, as shown in the letter attached as Exhibit 1 to this ordinance, the Middle Tennessee Council of the Boy Scouts of America (“MTC-BSA”) has requested the donation of the dock for use at its Boxwell Scout Reservation for use in connection with the teaching of canoeing, boating and water safety skills to Boy Scouts from Nashville and Middle Tennessee.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The dock shall be donated to the MTC-BSA, and the Director of the Department of Water and Sewerage Services shall take such measures as may be necessary to permit the MTC-BSA to take possession of the dock.

Section 2: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
