ORDINANCE NO. BL2012-185

An ordinance authorizing the acquisition of a sewer line easement on property located at 1114 Brookmeade Drive (Proposal No. 2012M-010ES-001).

WHEREAS, The Metropolitan Department of Water and Sewer Services desires to record an easement on land located at 1114 Brookmeade Drive, approximately 200 feet east of Duncanwood Drive; and,

WHEREAS, The property owners have agreed to grant an easement to the Metropolitan Government; and,

WHEREAS, The Department of Water and Sewerage Services has engineering records, incorporated herein by reference, that indicate that the easement contains approximately 235 square feet of land; and,

WHEREAS, The Metropolitan Planning Commission approved the acquisition of this easement in mandatory referral No. 2012M-010ES-001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property Administration is hereby authorized and directed to acquire, and if necessary, to take and appropriate by condemnation, the following described easement, shown on the attached map, for the purpose of construction or other use of sanitary sewers and/or appurtenances, the project being Project No. 11SG0009, the same being for a public purpose and the public convenience requiring it.

Section 2. The easement or property to be acquired is shown on the plans for Project No. 11SG0009, Brookmeade Sewer, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein by reference, and a list of the property address, and map and parcel number is as follows:

Section 3. All necessary and incidental costs of the land or easement herein authorized to be acquired shall be paid from funds authorized from the Extension and Replacement Fund.

Section 4. Amendments to this legislation shall be approved by resolution.

Section 5: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
