ORDINANCE NO. BL2012-167

An ordinance authorizing the Metropolitan Government to enter a participation agreement with 40th Avenue Church of Christ for the construction of approximately 2,300 lineal feet of a 12 inch water main and all appurtenances in 40th Avenue North from Charlotte Avenue to Catherine Johnson Parkway (Project No. 11-WG-0039).

WHEREAS, 40th Avenue Church of Christ has expressed a desire to improve the public water service for a proposed development and existing properties in the area; and,

WHEREAS, the improvements would include construction of approximately 2,300 lineal feet of a 12 inch water main and all appurtenances in 40th Avenue North from Charlotte Avenue to Catherine Johnson Parkway, Project No. 11-WG-0039; and,

WHEREAS, 40th Avenue Church of Christ has agreed to contribute twenty thousand dollars ($20,000) toward the improvements; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, is willing to accept 40th Avenue Church of Christ participation in the project and to operate and maintain the water improvement; and,

WHEREAS, It is in the best interests of the citizens of the Metropolitan Government that the attached participation agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement between the Metropolitan Government and 40th Avenue Church of Christ, to construct approximately 2,300 lineal feet of a 12 inch water main and all appurtenances in 40th Avenue North from Charlotte Avenue to Catherine Johnson Parkway, Project No. 11-WG-0039, attached hereto and incorporated herein by reference, is approved, and the Director of Water and Sewer Services is authorized to execute the same.

SECTION 2. 40th Avenue Church of Christ will contribute twenty thousand dollars ($20,000) to be deposited in the Water and Sewer Extension and Replacement Fund No. 47335 to assist in funding the construction, operation and maintenance for the improvements.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
