ORDINANCE NO. BL2012-166

An ordinance authorizing the Metropolitan Government to enter a participation agreement with Southern Land Company to repair approximately 50 lineal feet of an 18 inch public combined sewer main and install one public manhole near 2300 Elliston Place (Project No. 11-SL-36A).

WHEREAS, Southern Land Company has expressed a desire to improve the public sewer service by repairing approximately 50 lineal feet of an 18 inch public combined sewer main and installing one public manhole near 2300 Elliston Place, Project No. 11-SL-36A; and,

WHEREAS, The Metropolitan Department of Water and Sewerage Services is willing to accept Project No. 11-SL-36A and operate and maintain the improved sewer service; and,

WHEREAS, Southern Land Company agrees to pay fifty percent (50%) of the costs of constructing the improvements, up to twenty-two thousand dollars ($22,000); and,

WHEREAS, approval of the attached participation agreement is in the best interests of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Southern Land Company, to repair approximately 50 lineal feet of an 18 inch public combined sewer main and install one public manhole near 2300 Elliston Place, Project No. 11-SL-36A, attached hereto and incorporated herein by reference, is approved, and the Director of Water and Sewer Services is authorized to execute the same.

SECTION 2. The twenty-two thousand dollars ($22,000) from Southern Land Company will be deposited in the Water and Sewer Extension and Replacement Fund No. 47335 as a contribution to fund the construction, operation and maintenance of the proposed improvement.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
