ORDINANCE NO. BL2012-150

An ordinance to abandon 142 feet of an easement retained by Metropolitan Council Ordinance BL93-739 within the former right-of-way of Cross Hill Road at 124 A and 128 Alton Road (Proposal No. 2012M-008ES-001).

WHEREAS, Metropolitan Council Ordinance BL93-739 retained easement rights within the former right-of-way of Cross Hill Road at 124 A and 128 Alton Road and 142 feet of the easement is no longer being used by the Metropolitan Department of Water and Sewerage Services, nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this abandonment in mandatory referral No. 2012M-008ES-001 on February 27, 2012.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government abandons 142 feet of the water and sewer easement rights located at 124 A Alton Road, Map and Parcel Number 13009000200, and 128 Alton Road, Map and Parcel Number 13009002200, as indicated on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Director of the Metropolitan Department of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
