ORDINANCE NO. BL2012-148

An ordinance to abandon approximately 250 feet of a 6 inch water main and to accept 28 feet of an 8 inch DIP water main easement and one public fire hydrant located at 2014 Bernard Circle (Proposal No. 2012M-009ES-001).

WHEREAS, Belmont University has requested the abandonment of approximately 250 feet of a 6 inch water main and the acceptance of 28 feet of an 8 inch DIP water main easement and one public fire hydrant located on its property at 2014 Bernard Circle, on the east side of 15th Avenue South; and,

WHEREAS, Proposal No. 2012M-009ES-001 is on record at the Metropolitan Department of Water and Sewerage Services and incorporated herein by reference; and,

WHEREAS, the portion of the water main to be abandoned is no longer used by the Metropolitan Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this abandonment and acceptance in mandatory referral No. 2012M-009ES-001 on February 23, 2012.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government abandons approximately 250 feet of a 6 inch water main and accepts 28 feet of an 8 inch DIP water main easement and one public fire hydrant located at 2014 Bernard Circle, Map and Parcel: 10509010000, as shown on Exhibit 1, attached hereto and incorporated by reference.

Section 2. The Metropolitan Director of Water and Sewerage Services and the Metropolitan Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
