ORDINANCE NO. BL2012-144

An ordinance to abandon easement rights that were retained by Council Ordinance BL92-290 within the former right-of-way of 45th Avenue North on properties located at 4414 and 4502 Illinois Avenue (Proposal No. 2012M-004ES-001).

WHEREAS, Toni Rothfuss, Angel Sandoval, and Ana Hernandez, owners of 4414 and 4502 Illinois Avenue, have requested that the Metropolitan Government abandon the easement rights retained by Ordinance BL92-290, within the former right-of-way of 45th Avenue North; and,

WHEREAS, maps showing the easement rights are on record with the Metropolitan Department of Water and Sewerage Services and incorporated herein by reference; and,

WHEREAS, the easement rights are no longer being used by the Metropolitan Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this easement abandonment in mandatory referral No. 2012M-004ES-001 on February 13, 2012.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government hereby abandons the easement rights located at 4414 and 4502 Illinois Avenue, as indicated on Exhibit 1 attached hereto.

Section 2. The Metropolitan Director of Water and Sewerage Services and the Metropolitan Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to abandon said easement rights.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
