ORDINANCE NO. BL2012-132
An ordinance to abandon all easement rights that were retained by Council Ordinance BL81-519 within the former right-of-way of Alley No. 1218 on property located at 4502 Indiana Avenue (Proposal No. 2012M-005ES-001).
WHEREAS, James and T. Elaine Phelps, owners of 4502 Indiana Avenue, have requested the abandonment of all easement rights that were retained by Council Ordinance BL81-519 within the former right-of-way of Alley No. 1218; and,
WHEREAS, said easement rights are no longer being used by the Metropolitan Department of Water and Sewerage Services nor any other public utility; and,
WHEREAS, maps showing the easements are on record in the Metropolitan Department of Water and Sewerage Services and incorporated herein by reference; and,
WHEREAS, The Metropolitan Planning Commission approved abandonment of said easements in mandatory referral No. 2012M-005ES-001, on February 13, 2012.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government hereby abandons the easement rights located at 4502 Indiana Avenue, as indicated on the attached exhibit.
Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
