ORDINANCE NO. BL2012-126

An ordinance adopting a Vehicle Impoundment Policy for the Metropolitan Government.

WHEREAS, on December 6, 2011, the Council of the Metropolitan Government of Nashville and Davidson County enacted Ordinance No. BL2011-39 approving a contract with United Road Towing for the administration and operation of the Metro Impound Lot; and

WHEREAS, in addition to operation of the Metro Impound Lot, United Road Towing is the parent company of West Nashville Wrecker Services, which provides emergency towing services within the area of the Metropolitan Government; and

WHEREAS, the Metropolitan Nashville Chief of Police has promulgated General Order No. 09-01 providing the policy and procedures for the various aspects of the vehicle impound process; and

WHEREAS, General Order No. 09-01 includes, in part, provisions governing the circumstances under which motor vehicles may be impounded by the Metropolitan Nashville Police Department and delivered to the Metro Impound Lot; and

WHEREAS, in order to ensure a level playing field for all towing companies licensed to provide emergency towing services in Nashville and Davidson County, it is fitting and proper that General Order No. 09-01 be adopted by Ordinance as the official vehicle impound policy for the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That General Order No. 09-01 of the Metropolitan Police Department of Nashville and Davidson County, a copy of which is attached hereto and incorporated herein as “Exhibit A”, is hereby adopted as the official Vehicle Impoundment Policy for the Metropolitan Government.

Section 2. Future amendments or modifications to General Order No. 09-01 may be approved by a Resolution adopted by the Metropolitan Council.

Section 3. The Metropolitan Nashville Chief of Police shall have the authority to make temporary modifications or exceptions to General Order No. 09-01 in the event of an emergency as circumstances may dictate. Such temporary modifications or exceptions shall cease at the termination of the emergency situation.

Section 4. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
