ORDINANCE NO. BL2012-124

An ordinance approving the abandonment of four stormwater easements on properties located at 3711 and 3715 Crestview Drive and 1 University Park Drive (Proposal No. 2011M-021ES-001).

WHEREAS, David Lipscomb University has requested the abandonment of four stormwater easements on its properties including 3711 and 3715 Crestview Drive and 1 University Park Drive, all of which are shown on Exhibit 1; and,

WHEREAS, records in the Department of Water and Sewerage Services indicate that three of the listed stormwater easements are recorded in the Register of Deeds’ Office and one easement was retained in a road closure by BL2011-954; and,

WHEREAS, the easements are no longer used by the Department of Water and Sewerage Services, nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this abandonment in mandatory referral No. 2011M-021ES-001 on November 28, 2011.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government hereby abandons the easements on the attached Exhibit 1, incorporated by reference.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute such documents as may be necessary and appropriate to carry out the abandonment of the easements authorized by this ordinance and shown on Exhibit 1.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
