ORDINANCE NO. BL2012-112

An ordinance authorizing the acquisition of two easements on properties located at 7218 and 7220 Nolensville Road for a sewer project (Proposal No. 2012M-002ES-001).

WHEREAS, it is in the public interest that the two easements be accepted for construction or other use of water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances within the area designated for the construction of Project No. 10-SG-219A; and,

WHEREAS, Project No. 10-SG-219A has been funded under Capital Improvements Budget No. 09WS0018; and,

WHEREAS, The Metropolitan Planning Commission approved this project on December 16, 2011 to be built in Williamson County, Mandatory Referral #2012M-002ES-001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Director of Public Property Administration is hereby authorized and directed to acquire by negotiation or condemnation, the two easements on the properties listed below in the name of The Metropolitan Government of Nashville and Davidson County, for the purpose of construction or other use of water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances, the initial such project being Project No. 10-SG-219A, the same being for a public purpose and the public convenience requiring it.

Section 2. The two easements to be acquired are shown on the plans for Project No. 10-SG-219A, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, and the property addresses and map and parcel numbers are as follows:

Section 3. Acquisition of additional or different property interests for this project shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
