ORDINANCE NO. BL2011-86

An ordinance abandoning 450 feet of an 8 inch sanitary sewer line and public utility easements retained by Ordinance No. O65-483 and Ordinance No. O79-1477 and to accept the relocation of 234 feet of an 8 inch DIP sewer main and a manhole located at 28th Avenue North (unnumbered) (Proposal No. 2011M-015ES-001).

WHEREAS, it is in the interest of the Department of Water and Sewerage Services to accept the relocation of 234 feet of an 8 inch DIP sewer main and a manhole located at 28th Avenue North (unnumbered) at the northeast corner of Charlotte Avenue and 28th Avenue North and to abandon 450 feet of an 8 inch sanitary sewer line and public utility easements retained by Ordinance O65-483 and Ordinance O79-1477 that are no longer used by any public utility; and,

WHEREAS, the Metropolitan Planning Commission approved this abandonment and relocation in mandatory referral No. 2011M-015ES-001 on August 25, 2011.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government hereby abandons 450 feet of an 8 inch sanitary sewer line and public utility easements retained by Ordinance No. O65-483 and Ordinance No. O79-1477 and accepts the relocation of 234 feet of an 8 inch DIP sewer main and a manhole located at 28th Avenue North (unnumbered) at the northeast corner of Charlotte Avenue and 28th Avenue North as indicated on the attached Exhibit 1.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and relocations authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
