ORDINANCE NO. BL2011-8

An ordinance to abandon approximately 240 feet of a 102” combination sewer main and accept the approximately 400 feet of relocated 102” combination sewer main on property located at 220 25th Avenue North, at the intersection of 25th Avenue North and Brandau Place, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2011M-007ES-001).

WHEREAS, approximately 240 feet of a 102” combination sewer main and easement is no longer being used by the Department of Water and Sewerage Services nor any other public utility, and 400 feet of a relocated combination sewer main has been constructed and is ready for acceptance, both of which are more particularly described in Projects 11-SL-45 and 11WL-44, on record in the Department of Water and Sewerage Services and incorporated herein by reference; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2011M-007ES-001 on June 14, 2011, for abandonment and relocation of said easement and combination sewer main.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons approximately 240 feet of a 102” combination sewer main and accepts the approximately 400 feet of the relocated 102” combination sewer main on property located at 220 25th Avenue North, at the intersection of 25th Avenue North and Brandau Place, as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and relocation authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
