ORDINANCE NO. BL2011-7
An ordinance abandoning 86 linear feet of an 8 inch sanitary sewer line and easements rights on a portion of property located at 3308 John Mallette Drive between Manchester Avenue and S. Hamilton Road, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2011M-003ES-001).
WHEREAS, the 86 linear feet of an 8 inch sanitary sewer line and easement rights on a portion of property located at 3308 John Mallette Drive between Manchester Avenue and S. Hamilton Road (Project. No. 09-SL-0044), on record in the Department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2011M-003ES-001 on May 19, 2011 for abandonment of said property rights.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan Government hereby abandons the 86 linear feet of an 8 inch sanitary sewer line and easements rights on a portion of property located at 3308 John Mallette Drive between Manchester Avenue and S. Hamilton Road, as indicated on Exhibit 1 hereto.
Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
