ORDINANCE NO. BL2011-63

An ordinance authorizing the abandonment of 102 feet of storm sewer and a 10 foot public utility and drainage easement on properties located at 620 and 624 Belle Park Circle on the north side of Forrest Park Drive in connection with Project 11-DL-45 (Proposal No. 2011M-018ES-001).

WHEREAS, neither the Department of Water and Sewerage Services, nor any other public utility, is using 102 feet of storm sewer line or a 10 foot public utility and drainage easement on the properties located at 620 and 624 Belle Park Circle, also known as map 139-13A parcels 5.00.CO and 6.00.CO, on the north side of Forrest Park Drive (Project 11-DL-45); and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2011M-018ES-001 on September 19, 2011 for the abandonment of 102 feet of storm sewer line and a 10 foot public utility and drainage easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government abandons 102 feet of a storm sewer and a 10 foot public utility and drainage easement on properties located at 620 and 624 Belle Park Circle on the north side of Forrest Park Drive (Project 11-DL-45), also known as map139-13A parcels 5.00.CO and 6.00.CO, as indicated on the attached Exhibit 1.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonments authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
