ORDINANCE NO. BL2011-54

An ordinance authorizing the acquisition of a property or easement to be used for an upgrade to the Hillview Water Pumping Station, Project No. 10-WG-0063, on property located at 900 Old Hickory Boulevard (Proposal No. 2011M-011ES-001).

WHEREAS, it is in the public interest that property or easements be acquired to permit the construction or other use of water mains, sanitary sewers, reservoirs, stormwater faciliites and/or appurtenances within the area designated for the construction of Project No. 10-WG-0063, Hillview Water Pumping Station Improvements; and,

WHEREAS, Project No. 10-WG-0063, Hillview Water Pumping Station Improvements, has been funded under Capital Improvements Budget No. 09WS0017; and,

WHEREAS, The Metropolitan Planning Commission approved this acquisition on August 17, 2011, Proposal No. 2011M-011ES-001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Director of Public Property Administration is hereby authorized to acquire by negotiation or condemnation the following described easement and property, shown on the attached map, for the purpose of construction or other use of water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances, the initial such project being Project No. 10-WG-0063, the same being for a public purpose and the public convenience requiring it.

Section 2. The easement and property to be acquired is shown on the plans for Project No. 10-WG-0063, Hillview Water Pumping Station Improvements, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, the property address, map and parcel number is as follows:

Section 3. The Director of Public Property Administration is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for the construction or other use of water mains, sanitary sewers, reservoirs, stormwater and/or appurtenances.

Section 4. All necessary and incidental costs of the easement herein authorized to be acquired shall be paid from authorized funds within the Extension and Replacement Fund.

Section 5. Acquisition of additional or different easements or additional properties for these projects shall be approved by resolution.

Section 6. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
