ORDINANCE NO. BL2011-53

An ordinance authorizing the acceptance of a right-of-entry and easement from Grand Ole Opry, LLC on a portion of the property located at 116 Opry Place, approximately 215 feet south of Commerce Street, to install a fire hydrant (Proposal No. 2011M-019ES-001).

WHEREAS, it is in the public interest that a right-of-entry and easement be accepted for the construction of a fire hydrant on the property located at 116 Opry Place, approximately 215 feet South of Commerce Street, as part of water main construction in Project No. 11-WC-0057, Ryman Alley Refurbishment and Fire Hydrant Project; and,

WHEREAS, Project No. 11-WC-0057, Ryman Alley Refurbishment and Fire Hydrant Project, has been funded under Capital Improvements Budget No. 09WS0020; and,

WHEREAS, The Metropolitan Planning Commission approved the acquisition on October 6, 2011, Proposal No. 2011M-019ES-001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Director of Public Property Administration is hereby authorized to accept the attached right-of-entry and easement, attached as exhibit 1, for the purpose of construction or other use of water mains and/or appurtenances for Project No. 11-WC-0057, the same being for a public purpose and the public convenience requiring it.

Section 2. The easement acquired is shown on the plans for Project No. 11-WC-0057, Ryman Alley Refurbishment and Fire Hydrant, on record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, and the property address and map and parcel number are as follows:

Section 3. All necessary and incidental costs of the easement herein authorized to be acquired shall be paid from authorized funds within the Extension and Replacement Fund.

Section 4. Acquisition of additional or different easements or additional properties for these projects shall be approved by resolution.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
