ORDINANCE NO. BL2011-51

An ordinance approving two agreements relating to the acquisition of property for use as a public park and open space (Proposal No. 2011M-021PR-001).

WHEREAS, pursuant to the terms of the option agreement attached as Exhibit A and incorporated into this ordinance by reference, the Metropolitan Government proposes to purchase approximately 180.95 acres of real property (the “Club Tract”) currently comprising the Ravenwood Country Club and engage the current owner of the Club Tract to operate the pool, golf and tennis facilities thereon for approximately two years; and,

WHEREAS, pursuant to the terms of the agreement attached as Exhibit B and incorporated into this ordinance by reference, the Metropolitan Government proposes to convey approximately 4.9 acres of Club Tract property and pay the sum of $266,000 to Eddie Phillips in return for the extinguishment of certain special rights to use of the Club Tract property and facilities; and

WHEREAS, approval of Exhibits A and B will provide additional park and open space in Davidson County for the benefit of the public.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The agreements attached as Exhibit A and Exhibit B to this ordinance are approved, and the Director of Public Property, or his designee, is authorized to execute and deliver such instruments as are necessary to effect the property conveyances referenced therein.

Section 2. The net property obtained under this ordinance shall be placed under the administration of the Metropolitan Department of Parks and Recreation and devoted to public use as a park or open space.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
