ORDINANCE NO. BL2011-44

An ordinance authorizing the purchase of easements to be used for the Metro Center Pump Station Upgrade on properties located at the northeast corner of the intersection of Mainstream Drive and Great Circle Road, Project No. 12-SW-0017 (Proposal No. 2011M-016ES-001).

WHEREAS, it is in the public interest that easements be acquired to permit the construction or other use of water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances within the area designated for the construction of Project No. 12-SW-0017, Metro Center Pump Station Upgrade; which has been funded under Capital Improvements Budget No. 12-WS-001; and,

WHEREAS, The Metropolitan Planning Commission approved this acquisition on September 1, 2011, Proposal No. 2011M-016ES-001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Director of Public Property Administration is hereby authorized to acquire by negotiation or condemnation the easements shown on the attached map in the name of The Metropolitan Government of Nashville and Davidson County for the construction or other use of water mains, sanitary sewers, reservoirs, stormwater facilities and/or appurtenances.

Section 2. The easements to be acquired are shown on the plans for Project No. 12-SW-0017, Metro Center Pump Station Upgrade, which is of record in the Office of the Director of the Department of Water and Sewerage Services, and incorporated herein, and the property addresses and map and parcel numbers are as follows:

Section 3. All necessary and incidental costs of the easements herein authorized to be acquired shall be paid from authorized funds within the Stormwater Fund.

Section 4. Acquisition of additional or different easements or lands for these projects shall be approved by resolution.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
