ORDINANCE NO. BL2011-42

An ordinance authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 7822 with the State of Tennessee, Department of Transportation, Project No. 19959-2583-94, to construct PIN Number 106007.00, Battery Lane bridge over West Fork Brown’s Creek at LM 4.31.

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) plans to construct State Project No. 19959-2583-94 in Davidson County; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County, through its Department of Water and Sewerage Services, plans to construct the utility work identified as Project No. 10-SG-0208 and 10-WG-0099, identified in Capital Improvement Budget No. 09-WS-0016 and described in the attached Contract; and,

WHEREAS, it is in the interest of the Metropolitan Government that this utility work be carried out in the State project; and,

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 7822, attached hereto as Exhibit A, the Metropolitan Government will not be responsible for the cost of the utility work, which cost is currently estimated to be $218,375.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Mayor is hereby authorized to enter into Utility Relocation Contract No. 7822 with the State of Tennessee, Department of Transportation attached hereto as Exhibit A and incorporated herein.

Section 2. That the Director of Water and Sewerage Services is hereby authorized to enter into any supplemental agreements necessary to implement the Local Government Investment Pool Program.

Section 3. That the Metropolitan Government may enter into additional State of Tennessee, Department of Transportation, contracts relating to State Project No. 19959-2583-94 to construct 106007.00, Battery Lane bridge over West Fork Brown’s Creek at LM 4.31, located within The Metropolitan Government of Nashville and Davidson County by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2011-42 by deleting the fourth WHEREAS clause in its entirety and replacing it with the following: WHEREAS, pursuant to the terms of Utility Relocation Contract No. 7822, attached hereto as Exhibit A, the Metropolitan Government will be responsible for the cost of the utility work, which cost is currently estimated to be $218,375.
