ORDINANCE NO. BL2011-38

An ordinance approving a loan agreement and accepting a loan of artwork to the Metropolitan Government of Nashville and Davidson County.

WHEREAS, Duthie Associates, Inc. as representative for Graham Duthie (Artist) has offered to loan to the Metropolitan Government of Nashville and Davidson County a pastel triptych painting of Nashville by Mr. Duthie for no cost to Metro, as long as the painting is displayed in a Metropolitan building, accessible to the public; and,

WHEREAS, Metropolitan Code §2.112.030 provides that the purpose of the Metropolitan Nashville Arts Commission shall include providing recommendations to the metropolitan county council with respect to the aesthetics of public places and property; and,

WHEREAS, the Metropolitan Nashville Arts Commission has recommended the approval of the attached agreement for the loan and display of artwork; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this loan agreement be executed and this loan be accepted.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the loan agreement, attached hereto and incorporated herein, and loan of artwork to The Metropolitan Government of Nashville and Davidson County is hereby approved, to be used for public display, and the Metropolitan Nashville Arts Commission is authorized to execute any and all necessary agreements to accomplish the same.

Section 2. That any amendments, renewals, or extensions of the terms of this loan agreement shall be approved by resolution of the Metropolitan Council.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
