ORDINANCE NO. BL2011-33
An ordinance amending Chapter 4.44 of the Metropolitan Code to provide the ability for procurement assistance to Service-Disabled Veteran Business Enterprises.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. Chapter 4.44 of the Metropolitan Code is hereby amended by deleting the title of the chapter and substituting with the following new title:
Chapter 4.44 - ASSISTANCE TO SMALL, DISADVANTAGED, AND SERVICE-DISABLED VETERAN OWNED BUSINESSES
Section 2. Section 4.44.010 of the Metropolitan Code is hereby amended by adding the following new definitions:
“Service-Disabled Veteran” means any person who served honorably on active duty in the Armed Forces of the United States with at least a twenty percent (20%) disability that is service-connected meaning that such disability was incurred or aggravated in the line of duty in the active military, naval, or air service.
“Service-Disabled Veteran Owned Business” means a business that is a continuing, independent, for profit business located in Davidson County, Tennessee that performs a commercially useful function, and
1. Is at least fifty-one percent (51%) owned and controlled by one (1) or more service-disabled owned veterans;
2. In the case of a business solely owned by (1) service-disabled veteran and such person’s spouse, is at least fifty percent (50) owned and controlled by the service-disabled veteran; or
3. In the case of any publicly owned business, at least fifty-one percent (51%) of the stock of which is owned and controlled by one (1) or more service-disabled veteran and whose management and daily business operations are under the control of one (1) or more service-disabled veteran.
Section 3. Chapter 4.44 of the Metropolitan Code is hereby amended by deleting the phrases “small and disadvantaged businesses” and “small businesses”, wherein they appear in Sections 4.44.020, 4.44.030, 4.44.040, and 4.44.050, and substituting with the phrase “small, disadvantaged, and service-disabled veteran owned businesses”.
Section 4. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:
I move to amend Ordinance No. BL2011-33 by deleting the provisions of Section 3, renumbering the existing Section 4 as Section 5, and by adding the following new Sections 3 and 4:
Section 3. Chapter 4.44 of the Metropolitan Code is hereby amended by deleting the phrase "small and disadvantaged businesses" wherein it appears in Sections 4.44.020, 4.44.030, 4.44.040, and 4.44.050, and substituting with the phrase "small, disadvantaged, and service-disabled veteran owned businesses".
Section 4. Chapter 4.44 of the Metropolitan Code is hereby amended by deleting the phrase "small businesses" wherein it appears in Section 4.44.020, and substituting with the phrase "small and service-disabled veteran owned businesses".
